JCC Waiver

Household Participant Waiver, Indemnification of All Claims and Covenant Not to Sue

NOTICE:  THIS IS A LEGALLY BINDING AGREEMENT. Read this document carefully and in its entirety. By signing this agreement, you give up your right (and where you are signing as parent or guardian on behalf of a minor child, the minor child’s right) to bring a court or any other action to recover compensation or obtain any other remedy for any personal injury or property damage however caused arising out of your (or a minor’s) participation in any programs or activities (collectively, “JCC Greater Boston Programs and Activities”) sponsored or operated by or conducted at any facilities or on any equipment (collectively, “JCC Greater Boston Facilities”) owned or operated by The Jewish Community Centers of Greater Boston, Inc. (“JCC Greater Boston”) now or at any time in the future.

The words ”undersigned” or “I” as used in this document shall refer to each person signing below as though each is signing a separate document. Where a parent or guardian signs this document on behalf of a minor child, the words “undersigned” or “I” shall include the minor child or children named below.

Acknowledgment and Assumption of Risk

The undersigned hereby acknowledges and agrees that participation in any of the JCC Greater Boston Programs and Activities or access to or use of any JCC Greater Boston Facilities comes with inherent risks. I certify that I  have full knowledge and understanding of the nature and extent of the inherent risks associated with such participation and access, including, but in no way limited to: (1) personal injury, (2) property damage, (3) disability, (4) death, and (5) sickness or disease, including, without limitation, those caused by exposure to and infection with bacteria or viruses such as SAR-COV-2. I further acknowledge that the preceding list is not inclusive of all possible risks associated with the such participation, access and use, and that said list in no way limits the operation of this Agreement.

I hereby certify that I am voluntarily assuming all of the foregoing risks, including, without limitation, all risks associated with COVID-19.  Without limiting the foregoing, I understand that I will be solely responsible for and assume the risk of any loss or damage, including, without limitation, personal injury, property damage, or death, I sustain while accessing or using any of the JCC Greater Boston Facilities or participating in any of the JCC Greater Boston Programs and Activities. I further certify that I am in good health and that I have no conditions or impairments, including any conditions associated with COVID-19, which would preclude my safe participation in the JCC Greater Boston Programs and Activities or safe access to or use of any JCC Greater Boston Facilities, and/or the safe participation, access or use by other participants and JCC Greater Boston personnel.  

Waiver, Release, Indemnification & Covenant Not to Sue

In consideration of the undersigned’s participation in the JCC Greater Boston Programs and Activities and/or accessing or using the  JCC Greater Boston Facilities, I hereby unconditionally release on behalf of myself, my heirs, representatives, executors, administrators and assigns, JCC Greater Boston, its officers, directors, employees, volunteers, agents, representatives, insurers and anyone working under, through or in connection with any of them (collectively with JCC Greater Boston,  the “Releasees”) from  any liabilities, obligations, incidents, occurrences, causes of action, suits, claims, demands, losses, costs, expenses (including, without limitation, attorney’s fees), property damage and personal injuries, including, without limitation, death, disability, contracted diseases or illnesses (collectively, “Claims”), of any kind, nature or description whatsoever, known or unknown, foreseeable or unforeseeable, in law or in equity, no matter how caused, which I, my heirs, representatives, executors, administrators or assigns may have, now or in the future, against any of the Releasees arising out of, on account of or in any way related to the access to or use of  any of the JCC Greater Boston Facilities or participation in any of the JCC Greater Boston Programs and Activities, including, without limitation any travel provided to or therefrom,  whether such access, use or participation is supervised or unsupervised, and hereby waive all such Claims and covenant not to sue any of the Releasees for any such Claims.

Each of the undersigned signing below as a parent or guardian on behalf of any minor child or children whose names are set forth below, certifies  that each of the below named Minors is in good health and has no conditions or impairments, including any conditions associated with COVID-19, which would preclude the safe participation by the Minor in the JCC Greater Boston Programs and Activities or safe access to or use of any JCC Greater Boston Facilities, and/or the safe participation, access or use by other participants and JCC Greater Boston personnel.  I further certify that I am the parent or legal guardian of the Minor with authority to sign this agreement. I further understand that the terms of this agreement are legally binding and certify that I am signing this agreement of my own free will after having carefully read it.   

Each of the undersigned certifies that the date of birth set forth below my signature is true and accurate and that I am, therefore, of lawful age and otherwise legally competent to sign this agreement.  I further understand that the terms of this agreement are legally binding and certify that I am signing this agreement of my own free will after having carefully read it.
